The instructions below are for THIS document: G39 LFO Order
Heading
Copy the heading you filled out on the Petition re LFOs.
Filling Out the Order
Each section of the order is broken down into “the court finds” and “the court orders.” The “court finds” section refers to facts the court is using to grant relief. The “court orders” section explains the relief the court is granting. Much of the order should match boxes checked in the petition.
Step 1: Jurisdiction
The court finds
▢ Time since conviction: You should only check this box if it has been ten years since the date you were convicted. This is the date your judgment and sentence was filed.
▢ Time since release / extension: You should only check the second box if you checked the first box in the Jurisdiction section on your petition.
The court orders
▢ Expiration of LFO jurisdiction: If you checked either of the boxes above, you can check this box. In some cases it could be possible that the court can still collect Payments. If that is the case, the judge will uncheck this box before signing the order.
▢ Expiration of restitution jurisdiction: You can check this box if the offense was committed before July 1, 2000, AND it has been more than 10 years since you were released from total confinement or sentenced, which occurred later. In some cases, it could be possible that the court can still collect Payments. If that is the case, the judge will uncheck this box before signing the order.
Step 2: Reduce or Waive LFOs
A. LFO Relief Regardless of Ability to Pay:
The court finds:
▢ Restitution Interest After Payment of Principal: If you paid the restitution principal balance off you should check this box.
The court orders: Check all boxes to match the boxes you checked in the petition section 2A.
▢ Collection ▢ LFO interest ▢ DNA fee ▢ Restitution Interest Waiver After Payment of Principal
B. LFO Relief Due to Inability to Pay:
The court finds:
▢ Inability to Pay: Check this box if you would like the court to find you are unable to pay your LFOs. You are unable to Pay your LFOs if, in the Petition, you checked any of the boxes in the section 3. Declaration of Inability to Pay (Indigency).
▢ Release from total confinement: If you are requesting waiver of restitution interest that accrued during incarceration, fill out the dates of incarceration to match your petition.
▢ Notice of party entitled to restitution: You can leave this blank because in most cases you will not know what efforts the prosecutor made to reach the victim, if there is one in your case.
The court orders: Check all boxes to match the boxes you checked in the petition section 2B.
▢ Waiver of LFOs ▢ Waiver of Restitution Owed to an Insurer or State Agency ▢ Waiver of restitution interest during periods during total confinement ▢ Waiver of appellate and/or other case costs
Step 3: Process for Paying Any LFOs That Will Remain
You should fill out the section ▢ Additional Time and Payment Plan only if you filled out that section in the Petition.
Step 4: Other Relief
You should only fill out this section if you filled out section 5 in the petition.
