When a Person Must Register

• Must register within 3 business days.
• “Reside” means “to be habitually or systematically present at a place,” and includes 4 or more hours at a place per day for a duration of (a) 3 or more consecutive days, or (b) 10 or more days in a calendar month. Because 4 or more hours at a place constitutes a day, overnights are not required to establish a residence. §15-20A-4(20).

Residency/Presence/Location Restrictions

• May not reside with an unrelated person on the sex offense registry or unrelated minor.
• May not reside within 2,000 feet of a school, childcare facility, resident camp, victim, or victim’s immediate family.

Who Must Register/Duration of Registration

• Anyone with a sex offense must register.
• Duration is 10 years for some juvenile cases to lifetime for adults.

When a Person Must Register

• Alaska Stat. §12.63.010(a)3 requires in-person registration for any SO “present in the state” by “next working day.” However Alaska Department of Public Safety states that visitors for less than 30 days do not have to register, but must inform law enforcement of their presence by submitting a Temporary Presence Form.

When a Person Must Register

• Statutes do not list the initial registration/when a person must first register. Non-resident offense who reside in American Samoa for school or employment for more than 14 days or for an aggregate period exceeding 30 days in a calendar year must register.

When a Person Must Register

• If staying 3  days or more in a calendar year (consecutive or non-consecutive), must register within 48 hours. Within 48 hours after registering with the sheriff’s office, must report in person to the Department of Highway Safety and Motor Vehicles (DHSMV) with a copy of the completed sexual offender/predator registration form to obtain a valid Florida identification card or driver’s license.

When a Person Must Register

• Must register within 3 days if present for more than 3 days in a calendar year. Days do not have to be consecutive or in a row.

• A “child sex offender” not reside within 500 feet of school, playground, child care institution, day care center, part day child care facility, day care home, group day care, park/forest reserve, playground, or facility for patrons under 18 years of age. 730 ILCS 150/8.
• A “child sex offender may not be knowingly present in any public park building, a playground,  recreation area within any publicly accessible privately owned building, or any public park when persons under the age of 18 are present in the building or on the grounds ,and approach, contact, or communicate with a child under 18 years of age, unless the “child sex offender” a parent or guardian of a person under 18 years of age present in the building or on the grounds. “Public park” includes a park, forest preserve, bikeway, trail, or conservation area under the jurisdiction of the State or a unit of local government. 720 I.L.C.S. 5/Art. 11.
• A “child sex offender” may not knowingly loiter within 500 feet of a school building or property comprising any school while persons under the age of 18 are present in the building or on the grounds, unless the “child sex offender” is a parent or guardian of a student attending the school, and certain other conditions are met. 720 I.L.C.S. 5/Art. 11.

When a Person Must Register

• If seeking temporary lodging for 7 consecutive days or more, must register at least three days prior to departure unless an emergency situation has prevented the timely disclosure of information.RS 15:542.  If establishing residency, must register within 3 business days of doing so. RS 15:542. “Residence” means a dwelling where a person regularly resides, regardless of the number of days or nights spent there. RS 15:541

When a Person Must Register

• Convictions before Jan. 1, 2013: Registrants have 5 days to register with the state Bureau of Identification and 24 hours to register with local law enforcement using a form provided by the Bureau
• Convictions after Jan. 1, 2013: Registrants have 3 days to register with the state Bureau of Identification  and 24 hours to register with local law enforcement upon establishing a residence, using a form provided by the Bureau.
• “Residence” means 14 consecutive days in the state, or 30 days in one year.

When a Person Must Register

• Must register within 3 days if employed, going to school, establishing a temporary or permanent residence, begins to habitually live in the state, or enters the state as a transient. §11-705.
• Employment includes working or “carrying on a vocation,” and may be full time or part time for a  period of more than 14 consecutive days or for a total period of 30 days (non-consecutive) in a calendar year. The employment or vocation may be financially compensated, volunteered, or for the purpose of government or educational benefit.

• May not be present within 500 feet of school property, child care facility, public park, swimming pool, athletic complex, museum, or education/nature center, with exceptions.  566.148; 556.149; 566.150. Certain registrants cannot reside within 1,000 feet of the property line of a school, child care facility, or victim’s residence. 566.147. 
• Must follow all Halloween restrictions on conduct- Cannot have any contact with children with Halloween related activity. Must follow curfew from 5 pm to 10:30 pm on October 31st. 589.426.

• Local Law Enforcement Registration: There is conflicting information. According to Okalhoma Corrections (https://oklahoma.gov/content/dam/ok/en/doc/documents/policy/section-02/020307b.pdf), a person must register within 3 days if present for more than 7 consecutive days or 14 total days (non-consecutive) in a 60-day period, employed full or part-time (with or without compensation), or enrolled as a full or part-time student. However, state law says that a person must register within 2 days if they intend to be in the state for 5 consecutive days or longer, has full or part-time employment (with or without compensative) for more than five cumulative days in a 60 day period, or is enrolled as a full-time or part-time student. 57 OK Stat § 583 (2023).
• If spouse lives in state: Must register with the Department of Corrections within 2 days of entering the State if they intend to be in the state for 5 consecutive days or longer or an aggregate period of 5 days or longer in a calendar year. Residency/Presence/Location Restrictions

• Adult registrants are prohibited from living within 1,000 feet of a school.  Adult registrants may not enter school grounds if they have reason to believe children are present, have been present in the past 30 minutes, or will be present in the next 30 minutes. Adult registrants may not knowingly loiter on a public way within 1,000 feet of the property line of school grounds. There are various exceptions to these rules. §6-2-320.

Who Must Register/Duration of Registration

• If you have an out-of-state or federal sex offense conviction, you must register and then Wyoming will conduct a legal review to determine whether Wyoming has an equivalent statute and whether you have a further duty to register. Wyoming does not consider whether you are required to register in another state.
• Duration is 10 years to lifetime.

• Visitors may continue to be on the public sex offender registry even after leaving state.
• Up to $125 state fee plus up to 25% county fee for initial registration and up to $25 state fee plus 25% county fee for registry updates. May qualify for a fee waiver if you are indigent.
• Must submit DNA analysis at initial registration.
